![]() EU court upholds the approval of UK Hinkley NPP According to Europe’s second highest court, the British government aid offered to the project did not violate EU rules. The case is Case T-356/15 Austria v Commission.
EDF and China General Nuclear Power Corp are building the Hinkley Point C nuclear power station. The cost of the NPP is estimated at 19.6 billion pounds. It is expected to become operational in 2025, Reuters reports. The European Commission gave its approval to the project in 2014, stating that it did not see any competition issues. A previous Austrian government took issue with the decision and filed a case with the General Court in 2015. The main argument was that it contradicted EU the existing EU policy of supporting renewable energy. Luxembourg has also challenged the approval. With the support of more than 20 academics, politicians and renewable energy officials, it says that it distorts competition and contravenes rules on government subsidies. Another problematic issue is the guaranteed price for electricity from the NPP which is higher than market rates. However, the General Court dismissed Austria’s arguments. “The General Court confirms the decision by which the Commission approved the aid provided by the UK in favour of the Hinkley Point C nuclear power station,” judges said. The Court stated that Britain has the right to choose between the different energy sources. It is expected that the plant will provide 7% of Britain’s power needs in the future. Additionally, it will help with the replacement of the country’s ageing nuclear fleet and closing coal plants.
