NewsFrom Bulgaria25.01.2018 14:28 The CPC Has Started Studying the Electricity Market in Bulgaria
In relation to the announcements and statements about the presence of speculative prices of electric energy on the free market in the last few days along with doubts that there is a synchronised increase by the licensed traders of electricity, the Commission for Protection of Competition (CPC) announced that the competitive environment on the electricity market is being carefully observed.
In view of energy sector’s social and economic importance, public and institutional interest related to the free trade of electricity, the Commission conducts permanent monitoring of publicly available facts and circumstances affecting the enforcement of the Competition Protection Act (CPA), reads the CPC announcement.
It also states that the CPC has experience in studying and analysing the electricity market and throughout its long practice has reviewed numerous aspects of electricity production and trade, including access to transmission networks, supply of electricity at regulated and freely negotiated prices, electric energy balancing, the process of switching to freely negotiated prices and others.
In this respect, the CPC reminds that in June 2013 the Commission has carried out a sector analysis of the electricity production, trade, transmission and supply markets in the country for the period 2006 – 2012, approved by Decision No 800 from 3 March 2013. Following the conclusion of the analysis, the Commission initiated proceedings in order to establish an infringement under Articles 15 and 21 of the CPA, and informed the competent authorities about the necessity of measures to improve the competitive environment of the sector. The Commission also established that there is abuse of dominant positions by supply and distribution companies on the Bulgarian electricity market, and imposed sanctions of approximately 6 million BGN for violations, consisting of discriminating licensed electricity traders and restricting free trade of electric energy at freely negotiated prices.
This sector’s importance for society requires a new wide-ranging study of the electricity market to be conducted, which should provide the CPC with a detailed understanding of current market processes and the need to identify potential additional measures intended to contribute to the proper and efficient functioning of the competitive environment.
In order to improve the efficiency of its actions, as allowed by the law, the CPC should collect and analyse the required up-to-date information by using all necessary means to obtain it, including contacting the competent authorities, respective industry associations as well as consumer and trader organisations.
